Welcome to VocalisVN AI (hereinafter referred to as "We" or "the Application"). We are committed to protecting the privacy and security of our users' personal data.

This Privacy Policy is compiled in compliance with the laws of Vietnam, including Decree No. 13/2023/ND-CP on Personal Data Protection, the Law on Cyber Information Security, the Law on Cybersecurity, and other relevant legal regulations.

This policy explains how we collect, process, store, use, and protect your personal data when you install, use the desktop application (Desktop App), and visit the VocalisVN AI website.

1. Definitions and Roles of Parties

Under Vietnamese law on personal data protection:

• Data Subject: The individual identified by the personal data (the user installing and using VocalisVN AI).
• Personal Data Controller: The entity operating and developing VocalisVN AI, which decides the purposes and means of processing personal data.
• Personal Data Processor: The organization or individual processing data on behalf of the Data Controller (e.g., database hosting partners).

2. Types of Personal Data Collected

To provide and maintain the services, we collect the following groups of data:

a. Licensing & Device Authentication Data

• License Key: The code issued when you purchase or register for a trial of the application.
• Unique Device Identifier (Device ID / Machine GUID): Automatically generated through system hardware queries (Registry on Windows or Ioreg on macOS) to accurately link the license key to your device.
• Registration Info: Email, phone number, or name provided by you during the license registration/purchase.

b. EULA Acceptance Logs

• EULA Signing Status: Records the time and your agreement to the End User License Agreement (EULA) to synchronize with our system database.

c. Network Activities and Connection Logs

• IP Address: Automatically recorded when the application makes licensing requests, checks for updates, or submits technical support queries to the server.
• Server Logs: Connection timestamps, OS details (Windows/macOS), and technical error codes used for troubleshooting and debugging.

3. Purposes of Data Processing

We only process your personal data for the following legitimate purposes:

• License Authentication: Ensure your license is valid, preventing unauthorized software reproduction or usage across multiple devices exceeding the license limit.
• Agreement Synchronization: Manage EULA signatures to protect the legal rights of both the user and the developer.
• Technical Support & Improvement: Analyze system errors and connection logs to optimize application performance, voice synthesis speed, and stability.
• Intellectual Property Protection (Audio Watermarking):
  • The system automatically embeds an inaudible secure code (Audio Watermark) into the output audio files.
  • Purpose: To help you verify exclusive ownership of your audio content, and support the detection of counterfeiting, copyright infringement, or misuse on the internet.

4. Consent and Withdrawal of Consent

• By checking "I agree" when activating the License Key or signing the EULA, you confirm that you have read, understood, and fully agreed to allow us to process your personal data for the purposes outlined in Section 3.
• You have the right to withdraw your consent at any time by stopping the use of the software, uninstalling the application, and requesting the deletion of your account/licensing data via our support email. Withdrawal of consent does not affect the legality of prior data processing activities.

5. Retention Period and Data Sharing

a. Data Retention Period

• Licensing-related data (License Key, Device ID, registered Email) and EULA signatures are stored throughout your service usage and up to 5 years after the termination of the license contract to resolve any potential legal disputes.
• Server logs and connection IPs are stored temporarily for 90 days for cybersecurity purposes, after which they are automatically deleted or anonymized.

b. Data Sharing & Third-Party Transfers

We commit NOT to sell, rent, trade, or share your personal data with any third party for commercial purposes.

Personal data is only shared in special circumstances:

• In response to formal legal requests by authorized government agencies in Vietnam (Courts, Procuracy, Police) for investigative purposes.
• With database cloud hosting partners that have signed equivalent non-disclosure agreements.

6. Data Subject Rights & Protection

Under Decree 13/2023/ND-CP, as a data subject, you have the following rights:

• Right to be informed & Right to consent: Be clearly notified of data processing activities and voluntarily choose whether to allow them.
• Right of access & provision: Request confirmation of data processing and obtain a copy of your stored personal data.
• Right to correction: Request updates or corrections to inaccurate licensing registration info.
• Right to erasure: Request permanent deletion of your personal data on licensing authentication servers.
• Right to object & restrict processing: Request to stop or restrict part of your data processing.
• Right to complain & sue: Bring the case before authorized state agencies or courts if you believe your privacy rights are violated.

7. Data Security Measures

We implement strict technical and organizational security measures to prevent unauthorized access, leakage, or loss of data:

• Transmission Encryption: All data transmitted between the desktop application and the authentication server is encrypted using HTTPS/TLS protocol.
• Restricted Access: Only authorized technical personnel have access to the databases for system maintenance purposes.
• Local Protection: The application is securely compiled to prevent reverse engineering that could extract device IDs or compromise user privacy.

8. Changes to the Privacy Policy

We may update this privacy policy from time to time to reflect technical updates in the application or new legal requirements. The latest version will always be published on our website and notified in the application. Continued use of the application constitutes acceptance of the updated policy.
